In Memoriam — Tim Kennedy
Tim Kennedy (January 4, 1949 – July 23, 2009) was a founding partner of Montross Miller who practiced law with the firm from 1977. He served clients in medical malpractice and personal injury litigation. Twice — in 2004 and 2009 — he was chosen by the Indiana Trial Lawyers Association as its Trial Lawyer of the Year. In 2009, the honor recognized his outstanding work in Spar v. Cha, in which the Indiana Supreme Court held that incurred risk is not a defense to a medical malpractice claim based upon negligence or lack of informed consent. Outside the firm, Tim was active in community theatre (Shakespeare in the Park in Noblesville and Main Street productions), the Adam Miller Memorial Fundraiser for the YMCA, and was a member of the Knights of Columbus. He participated in planning and implementing relief missions to Mexico with CrossRoads Church of Westfield. He chaired Indianapolis Bar Association grievance committees for more than twenty years.
