Tennessee Personal Injury Law — What Clients Need to Know
The firm's website educates clients on key Tennessee rules that affect injury claims. Tennessee operates under an 'at-fault' system for car accidents, meaning the at-fault driver (or another negligent party) is responsible for paying damages. To recover compensation, an injured person must generally prove four elements of negligence: contact, duty of care, breach of that duty, causation, and damages. The state has one of the shortest personal injury statutes of limitations in the country, generally giving victims only one year from the date of the accident to file suit under Tenn. Code Ann. § 28-3-104. While economic damages (like medical bills and lost wages) are not generally capped, non-economic damages for pain and suffering, emotional distress, and loss of enjoyment of life are capped at $750,000 under Tenn. Code Ann. § 29-39-102, and the cap may rise to $1,000,000 in catastrophic injury cases such as spinal cord injuries, severe burns, or amputations.
